Rules and conditions for using the Kelsey’s Heroes website, online services, program information and related resources.

These Terms of Use (“Terms”) govern your access to and use of the Kelsey’s Heroes, Inc. website and related online services (collectively, the “Website”). By accessing or using the Website, you agree to these Terms.

If you do not agree with these Terms, please do not use the Website.

1. About Kelsey’s Heroes

Kelsey’s Heroes, Inc. is a nonprofit organization serving children, young adults, families and the community through adaptive and inclusive sports, activities, events, scholarships and related community programs.

The Website provides information about our organization, programs, events, registration opportunities, volunteer opportunities, sponsorships, donations, scholarships and other community activities.

2. Permitted Use of the Website

You may use the Website for lawful, personal, informational and community-related purposes consistent with the mission and activities of Kelsey’s Heroes.

3. Program, Activity and Event Information

We make reasonable efforts to keep information about programs, sports, activities and events accurate and current. However, schedules, locations, eligibility details, capacity, volunteers, weather conditions and other circumstances may change.

Information on the Website does not guarantee participation, availability or acceptance into any program or event.

Specific programs, registrations or events may include additional requirements, forms, waivers, permissions or instructions that apply in addition to these Terms.

4. Parents, Guardians and Information About Minors

Kelsey’s Heroes serves children and young adults, including individuals with special needs. When information about a minor is requested through the Website, forms should be completed by a parent, legal guardian, caregiver or other authorized adult as appropriate.

By submitting information regarding a minor, you represent that you have authority to provide that information and to communicate with Kelsey’s Heroes regarding the individual.

5. Registration and Participation

Submitting an inquiry, registration form or request through the Website does not by itself guarantee acceptance, placement or participation.

Participation may depend on program capacity, scheduling, completed forms, permissions, safety requirements and other program-specific considerations communicated by Kelsey’s Heroes.

Where a separate waiver, release, consent form or participation agreement is required, that document will control with respect to the subject it covers.

6. Scholarship Information

Scholarship information provided on the Website is intended to explain the current application process and requirements made available by Kelsey’s Heroes.

Applicants are responsible for reviewing the current scholarship materials, deadlines and submission instructions. Submission of an application does not guarantee an award.

If information on a downloadable scholarship document differs from general Website content, the current official scholarship application materials should be followed.

7. Donations and Payments

Donations or other payments made through the Website may be processed by a third-party payment provider such as PayPal.

Your use of a third-party payment service is also subject to that provider’s terms, policies and security practices.

Any special terms relating to a particular event, sponsorship, registration or transaction will be presented separately when applicable. Nothing in these Terms creates a refund policy where one has not otherwise been stated.

8. Volunteer, Sponsor and Community Partner Inquiries

Submitting a volunteer, sponsorship or partnership inquiry does not create an employment relationship, agency relationship, sponsorship agreement, partnership or other binding commitment.

Any formal relationship may require additional review, approval, documentation or a separate written agreement.

9. Website Content and Intellectual Property

Unless otherwise stated, Website content—including text, logos, graphics, photographs, videos, design elements and other materials—is owned by, licensed to, or used with permission by Kelsey’s Heroes and is protected by applicable intellectual property laws.

You may view and share links to publicly available Website pages for personal, informational and community purposes. You may not reproduce, modify, sell, license or commercially exploit Website content without permission when permission is required by law.

Third-party names, logos, photographs and other materials remain the property of their respective owners.

The Website may include photographs, stories, testimonials or other content involving athletes, families, volunteers, sponsors and community events.
